Probate
A properly drafted will is necessary to ensure property distribution in accordance with your desires. Probate is the procedure to establish a will's validity. A will's validity is established by proving proper execution, the absence of undue influence or fraud, and the decedent's mental or testamentary capacity to prepare a will. However, even if established during probate, a will's validity does not make it immune from challenges to the validity or legal effect of particular provisions.

Estate Administration
When a spouse, parent or significant other has a trust and passes away, rather than a traditional probate, there is a simplified estate administration process. I can assist the trustee or your family in processing the estate administration at that difficult time. Among other things, I can work with the surviving relatives to make sure the terms of the trust are carried out for the benefit of the beneficiaries. I can also assist preparing whatever documents are needed to smooth the transition to the next generation. I can work with your accountant and other financial advisors to deal with the various tasks associated with estate administration.
In certain instances there may be disagreements or disputes between the trustee and certain beneficiaries regarding interpreting the terms and provisions of the trust. I am able to assist those beneficiaries in pursuing a Trust and Estate Dispute Resolution Act (“TEDRA”) action to protect their rights under the trust.
